COLLECTION OF INFORMATION


Information That You Provide to Us
PGA TOUR Superstore may collect information that you provide directly to PGA TOUR Superstore through the Sites. For example, we collect information when you set up an account, submit an order, participate in promotional activities, or communicate with PGA TOUR Superstore through the Sites. This information may include: (1) personally-identifiable information, which is information that identifies you personally, such as your first and last name, email address, phone number, mailing address, financial account information, social media account handles, and/or professional information (“Personal Information”); and (2) demographic information, such as age, gender, zip code, interests, and recent and upcoming purchases (“Demographic Information”). The information we collect may also include information that you submit about others, including the name, e-mail address, or physical address of a gift recipient. This information will be treated as Personal Information under the Policy.

Except to the extent required by law, Demographic Information is not treated as Personal Information under this Policy. Also, in certain instances, PGA TOUR Superstore may modify or extract personally-identifiable elements from Personal Information through anonymization, pseudonymization, or hashing. Such information is considered to be non-Personal Information and may be shared without obligation to you, except as prohibited by applicable law. However, to the extent that any non-Personal Information is combined by or on behalf of PGA TOUR Superstore with Personal Information, we will treat the resulting data as Personal Information under this Policy.

Information Collected Automatically
PGA TOUR Superstore may also automatically collect and log certain information about you when you access or use the Sites (“Usage Information”). Usage Information may include IP address, device identifier, browser type, operating system, approximate geographic area or location positioning information, information about your use of the Sites, and data regarding network connected hardware (e.g., computer or mobile device). Usage Information may also include your mobile device such as the type and model, operating system (e.g. iOS or Android), carrier name, mobile browser (e.g. Chrome, Safari), applications using our Website, and identifiers assigned to your device, such as its iOS Identifier for Advertising (IDFA), Android Advertising ID (AAID), or unique device identifier. Except to the extent required by applicable law, or to the extent that Usage Information is combined with other forms of personal information, PGA TOUR Superstore does not consider Usage Information to be Personal Information.

Information That We Collect from Other Sources
PGA TOUR Superstore may obtain information about you from other sources, including its affiliates, vendors, or third-party service providers, and combine it with your Personal Information. Notwithstanding anything to the contrary, this Policy is not intended to limit PGA TOUR Superstore’s activities regarding such third-party-source information and, to the extent permitted by applicable law, will treat such data as Personal Information under this Policy if, and to the extent that, it is combined with other sources of information that were independently collected by PGA TOUR Superstore.

PGA TOUR Superstore may use the following methods to collect Usage Information on the Sites:

Log Information
We also collect and review web log information to understand how you interact with the Sites. The information gathered in this format may include your IP address, browser type, Internet service provider, referring/exit pages, operating system, date and time stamps, and related data.

Web Beacons
Some of our Site’s web pages may use web beacons in conjunction with cookies to compile aggregate statistics about the Sites usage. A web beacon is an electronic image (also referred to as an “action tag,” “single-pixel,” or “clear GIF”) that is commonly used to track the traffic patterns of users from one web page to another in order to maximize web traffic flow and to analyze the effectiveness of websites. PGA TOUR Superstore may use “cookies” to collect information about your visit to our Sites and to manage information concerning your preferences. Advertising Cookies Advertising cookies track activity across websites in order to understand a viewer’s interests, and to direct marketing to them.

We sometimes use cookies delivered by us or by third parties to show you ads for our products that we think may interest you on devices you use and to track the performance of our advertisements. For example, these cookies collect information such as which browser you used when visiting our Sites.

PGA TOUR Superstore also contracts with third-party advertising networks that collect IP addresses and other information from web beacons on our websites, from emails and on third-party websites. USE OF INFORMATION


PGA TOUR Superstore may use information about you for any purpose that is not inconsistent with this Policy or a statement made by PGA TOUR Superstore at the point of collection, including, without limitation, the following:
  • Allow you to participate in the services offered on the Sites;
  • Facilitate, manage, personalize, and improve your online experience;
  • Process your registration or manage your membership account;
  • Transact with you, provide services or information you request, respond to your comments, questions and requests, serve you content and/or advertising, and send you notices or other relevant communications;
  • Provide you with promotional materials related to PGA TOUR Superstore products and/or services, and the products and/or services of our partners and partnerships;
  • Enable you to participate in a variety of the Sites features, including online entry sweepstakes, contests, or other promotions;

SHARING OF INFORMATION


PGA TOUR Superstore may share your Personal Information, Demographic Information, and/or Usage Information with our affiliates, business partners, and vendors that provide services on our behalf. These parties are not meant to use Personal Information except in connection with its provision of products and services. Absent your consent, PGA TOUR Superstore does not authorize these third-parties to use Personal Information provided by PGA TOUR Superstore to send you direct marketing messages other than communications related to our services and products.

Our sharing of Personal Information is, however, subject to the following:
  • Marketing. Subject to your communications choices explained below, we may use your Personal Information to send you marketing communications. However, PGA TOUR Superstore will never provide our promotional affiliates with Personal Information unless you “opt-in” (and do not “opt-out”), in accordance with our opt-out procedure, to receiving communications.
  • Your Disclosure or Consent. Your activities on the Sites may, by their nature, result in the sharing of your Personal Information with third parties. By engaging in these activities, you consent to that and further sharing of your Personal Information with third parties. Such third-party data collection is subject to the privacy and business practices of that third party, not PGA TOUR Superstore.
  • When You Request Us to Provide Information to Third Parties. When ordering products or interacting with certain services offered on the Sites, you may be presented with an option to have PGA TOUR Superstore send certain pieces of information to third parties. If you permit us to share the information, your Personal Information and/or Demographic Information, once disclosed, will be subject to the privacy policies and practices of the third-parties. We are not responsible for the privacy policies and practices of such third parties and, therefore, encourage you to review their privacy policies and notices prior to requesting that we provide them with your information.
  • Co-Branded Areas. Certain areas of the Sites may be provided to you in association with third parties (“Co-Branded Areas”), such as sponsors or charities, and may request or require you to disclose Personal Information to them. Such Co-Branded Areas will identify the third party and indicate if they have a privacy policy that applies to their collection and use of your information. If you elect to register for products and/or services, communicate with such third parties, or download their content or applications, you may be providing your information to both PGA TOUR Superstore and the third party. We are not responsible for such third party’s data practices and encourage you to review the third-party’s privacy policies for more information.
  • Sweepstakes, Contests and Promotions. PGA TOUR Superstore may offer sweepstakes, contests, and other promotions (each, a “Promotion”), including Promotions jointly sponsored or offered by third parties, which may require submitting Personal Information. If you voluntarily choose to enter a Promotion, your information, including Personal Information, may be disclosed to PGA TOUR Superstore, co-sponsors, and other third parties. By entering, you are agreeing to the official rules that govern that Promotion, which may include consent to additional or differing data practices from those contained in this Policy. Please review those rules carefully.
  • EEOC/Affirmative Action Reporting. To the extent that you apply for or are otherwise considered as a candidate for employment with PGA TOUR Superstore, in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission (“EEOC”), the Office of Federal Contract Compliance Programs (“OFCCP”) and similar state and local regulatory agencies, we may ask you to provide us with self-identifying information (such as veteran status, gender and ethnicity). Providing such self-identifying information is voluntary, but if you do provide us with information, we may submit that information, to the EEOC, the OFCCP and/or similar state and local regulatory agencies or otherwise use or disclose it for business-related purposes, including, without limitation, responding to information requests, fulfilling regulatory reporting requirements and defending against employment related complaints.
Under certain circumstances, PGA TOUR Superstore reserves the right to disclose your Personal Information to a third party if it is necessary to:
  • Comply with the law, law enforcement or other legal process, and, where permitted, in response to a government request;
  • If PGA TOUR Superstore believes your actions are inconsistent with PGA TOUR Superstore’s Terms and Conditions, policies, or any other notice made about the use of this Website;
  • Protect the rights, property, life, health, security and safety of PGA TOUR Superstore, its customers, or any third party; or
  • In connection with any proposed or actual financing of our business, or merger, purchase, sale, joint venture, or any other type of acquisition or business combination of all or any portion of PGA TOUR Superstore assets, or transfer of all or a portion of PGA TOUR Superstore’s business to another company, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.

THIRD-PARTY CONTENT


The Sites include functionality that allows certain kinds of interactions with a website, platform, tool, application, or other service that is not owned or operated by PGA TOUR Superstore (“Third-Party Services”). For example, we provide interfaces or links on the Sites to facilitate your sending a communication from the Sites (e.g., tweets, “likes”, content submissions, or other postings on social media platforms). Unless otherwise indicated, this Privacy Policy does not apply to Third-Party Services. We encourage you to review the applicable third-party privacy policies or notices to understand how they collect, use, or disclose your Personal Information. PGA TOUR Superstore is not responsible for the content or privacy practices of linked websites that it does not control.

If you choose to use any Third-Party Services to enhance your use of the Sites, the providers of those Third-Party Services may send Personal Information about you to PGA TOUR Superstore. To the extent that we combine such third-party sourced information, we will treat that as Personal Information under the Policy. If we discontinue use of any Third-Party Services, you consent that we may nevertheless retain any Personal Information, and other information or data, that we may have already received in connection with this Policy.

TRACKING AND COMMUNICATIONS OPTIONS


Accessing and Changing Information
The Sites may allow you to delete, correct, or update some of the Personal Information you provided to PGA TOUR Superstore. We will make good faith efforts to make requested changes in our then-active databases as soon as practicable, but it is not always possible to completely change, remove or delete all of your information as residual and/or cached data may remain archived thereafter. Further, we reserve the right to retain data (i) as required by applicable law; and (ii) for so long as reasonably necessary to fulfill the purposes for which the data is collected (e.g., business records).

Tracking Technologies Generally
Cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options so you may need to set them separately. Also, tools from commercial browsers may not be effective with regard to Flash cookies, HTML5 cookies or other Tracking Technologies. For information on disabling Flash cookies, please reference the Cookies and Other Tracking Technologies section above. Please be aware that if you disable or remove these technologies, some parts of the Sites may not function as they ordinarily would.

While some internet browsers offer a “do not track” or “DNT” option that lets you tell websites that you do not want to have your online activities tracked, these features are not yet uniform and there is no common standard adopted by industry groups, technology companies, or regulators. Promotional Communications
You can opt out of receiving promotional communications from PGA TOUR Superstore at any time by (i) following the instructions provided in emails to click on the unsubscribe link; or (ii) logging onto your membership account and changing your communication preferences.

Please note that if you elect to opt-out of PGA TOUR Superstore communications, you will also be opting-out of receiving promotional communications from its affiliates. However, even if you opt-out of receiving promotional communications, PGA TOUR Superstore may, subject to applicable law, continue to send you non-promotional communications, such as those about your account, transactions, servicing, or PGA TOUR Superstore’s ongoing business relations. Your opt-out preferences are limited to the e-mail address or phone number used and will not affect subsequent subscriptions.

CHILDREN’S ONLINE PRIVACY PROTECTION


The Sites are not directed to children, and PGA TOUR Superstore does not knowingly collect personal information from children under the age of 13 through the Sites. If we learn that we have received personal information from a child under the age of 13 through our Sites, we will delete the information in accordance with applicable law.

DATA SECURITY


PGA TOUR Superstore takes reasonable measures to protect personal information collected through the Sites from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. Nevertheless, transmission via the Internet and online digital storage are not completely secure, so we cannot guarantee the security of your personal information collected through our Sites.

QUESTIONS AND UPDATES TO THE POLICY


To the extent allowed by applicable law, PGA TOUR Superstore reserves the right to change or modify this Policy at any time and will notify you of material changes by posting the changed or modified Policy on our Sites. Any changes will be effective immediately upon the posting of the revised Policy unless otherwise specified. If you are using the Sites and are located in the European Economic Area, we may collect your “Personal Data” (as defined by the EU General Data Protection Regulation 2016/679 (“GDPR”)), which is governed by the additional terms contained in this Section. This Section does not apply to you if you are located outside of the European Economic Area (“EEA”).

WHO IS RESPONSIBLE FOR YOUR PERSONAL DATA?


PGA TOUR Superstore is the controller of your Personal Data as described in this Privacy Policy, unless specified otherwise. This Policy does not apply to the extent the we process Personal Data in the role of a processor or service provider on behalf of our customers.

PURPOSES FOR WHICH PERSONAL DATA IS PROCESSED


We collect and process your Personal Data for the purposes and on the legitimate legal bases identified in the following:
  • Providing our Services: We process your Personal Data to perform the services and fulfill our obligations under the applicable Terms of Use; if we have not entered into a contract with you, we base the processing of your Personal Data on our legitimate interest to operate and administer our Sites and to provide you with the content that you access and request;
  • Promoting the Security of Our Sites: We process your Personal Data by tracking your use of our Sites, creating aggregated non-personal information, verifying accounts and activity, investigating suspicious activity, and enforcing our Terms of Use to the extent it is necessary to protect our legitimate interest in promoting the safety and security of the Sites, systems and applications, and in protecting our rights and the rights of others;
  • Managing User Registrations: If you have registered for a membership account, we process your Personal Data by managing your account for the purpose of performing our contract with you according to applicable Terms of Use;
  • Handling Contact and User Support Requests: If you fill out a “Contact Me” web form or request user support, or if you contact us by other means including via a phone call or email, we process your Personal Data to perform our contract with you and to the extent it is necessary for our legitimate interest in fulfilling your requests and communicating with you;
  • Managing Event Registrations and Attendance: We process your Personal Data to plan and host events for which you have registered or that you may attend, including sending related communications to you;
  • Managing Contests or Promotions: If you register for a contest or promotion, we process your Personal Data to perform our contract with you. Some contests or promotions have additional rules containing information about how we will process your Personal Data;
  • Managing Payments: If you have provided financial information to us, we process your Personal Data to verify that information and to collect payments to the extent that doing so is necessary to complete a transaction;
  • Developing and Improving our Sites and Services: We process your Personal Data to analyze trends and to track your usage of and interactions with our Sites to the extent it is necessary for our legitimate interest in developing and improving our Sites and providing our users with more relevant content and service offerings;
  • Reviewing Compliance with Applicable Usage Terms: We process your Personal Data to review compliance with the applicable usage terms in our customer’s contract to the extent that it is in our legitimate interest to ensure adherence to the relevant terms;
  • Assessing Capacity Requirements: We process your Personal Data to assess the capacity requirements of our Sites the extent that it is in our legitimate interest to ensure that we are meeting the necessary capacity requirements of our service offerings;
  • Identifying Customer Opportunities: We process your Personal Data to assess new potential customer opportunities to the extent that it is in our legitimate interest to ensure that we are meeting the demands of our customers;
  • Displaying Personalized Advertisements and Content: We process your Personal Data in order to conduct marketing research, advertise to you, provide you with personalized information about us, and to provide other personalized content based upon your activities and interests to the extent it is necessary for our legitimate interest in advertising our Sites or, where necessary, to the extent you have provided your prior consent;
  • Sending Marketing Communications: We will process your Personal Data to send you marketing information, product recommendations, and other non-transactional communications (e.g., marketing newsletters or push notifications) about us and our affiliates and partners, including information about our products, promotions or events as necessary for our legitimate interest in conducting direct marketing or, where necessary, to the extent you have provided your prior consent; and

If we need to collect and process Personal Data by law, or under a contract we have entered into with you, and you fail to provide the required Personal Data when requested, we may not be able to perform our contract with you.

DATA RETENTION


We will store your Personal Data for no longer than is necessary for the performance of our obligations or to achieve the purposes for which the information was collected, or as may be permitted under applicable law. To determine the appropriate retention period, we will consider the amount, nature, and sensitivity of the data; the potential risk of harm from unauthorized use or disclosure of the data; the purposes for which we process the data and whether we can achieve those purposes through other means; and the applicable legal requirements. Unless otherwise required by applicable law, at the end of the retention period we will remove Personal Data from our systems and records or take appropriate steps to properly anonymize it.

INTERNATIONAL TRANSFERS OF PERSONAL DATA


Your Personal Data may be collected, transferred to, and stored by us in the United States and by our affiliates and third-parties that are based in other countries. If we transfer Personal Data to countries outside of the European Union, we will ensure that we transfer the information to parties that provide adequate safeguards for your Personal Data. This may include parties that have self-certified to the EU-U.S. Privacy Shield, implemented binding corporate rules, or adopted standard model clauses approved by the European Commission. You have certain choices regarding the treatment of your Personal Data. Depending on the applicable laws these rights may include the right to:
  • Access your Personal Data held by us;
  • Know more about how we processed your Personal Data;
  • Rectify inaccurate Personal Data and, taking into account the purpose of processing the Personal Data, ensure it is complete;
  • Erase or delete your Personal Data;
  • Restrict our processing of your Personal Data;
  • Transfer your Personal Data to another controller, to the extent possible;
  • Object to any processing of your Personal Data carried out on the basis of our legitimate interests. Where we process your Personal Data for direct marketing purposes, you can exercise your right to object at any time to such processing without having to provide any specific reason for such objection;
  • Opt-out of certain disclosures of your Personal Data to third parties;
  • Not be subject to a decision based solely on automated processing, including profiling, which produces legal effects ("Automated Decision-Making"). Automated Decision-Making currently does not take place on our Sites; and
  • Withdraw your consent at any time (to the extent we base processing on consent), without affecting the lawfulness of the processing based on such consent before its withdrawal.
Before we are able to provide, delete, or change any of your information, or otherwise respond to your request to exercise your rights, we may ask that you verify your identity. We may also ask for more details to help us respond to your request. We encourage you to promptly update your personal data if it changes.

NOTICE TO CALIFORNIA RESIDENTS


This California Privacy Notice is effective as of January 1, 2020.

This notice reflects our good faith understanding of the law and our data practices as of the date posted above, but the CCPA’s implementing regulations are not yet final and there remain differing interpretations of the law.     EXERCISING YOUR CALIFORNIA ACCESS, DELETION AND DO NOT SELL RIGHTS


    California residents have the right to request that we disclose to you what Personal Information we collect, use, disclose, and sell, including the right to request that we provide to you the specific pieces of Personal Information we have collected about you in the prior 12 months ("Right to Know") and you have the right to ask us to delete the Personal Information we collect about you ("Right to Delete"), subject to exceptions set forth in the CCPA. Please note that you may delete certain Personal Information you have provided to us through your online account.

    California residents also have the right to opt-out from the sale of their Personal Information. These rights are subject to some limitations, such as when we are retaining data to comply with our own legal obligations. You will not be required to create an account with us in order to submit a request.

    Making A Request
    To request the specific pieces of Personal Information we have collected about you in the prior 12 months, please call 1-888-200-7428 or email us at customerservice@pgatss.com. We will provide the requested information free of charge up to two (2) times in a 12-month period, but please note that where we receive unfounded, excessive, or repetitive requests, we may elect to decline the request. We will not retain information we do not ordinarily retain in the course of our regular business practices.

    Verifying Requests
    Please note that we will take steps to verify your identity in order to fulfill your request. We will first verify your email address is active and we will take steps to verify the information you provide to us. If you have an account with us, please have your account information available when you call or visit our portal to facilitate verification.

    If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf) we will not process the request.

    Response Timing
    When you request access to the Personal Information we have collected or deletion of your Personal Information, we will typically provide the requested information within 60 days, and we will notify you within that time period if we need additional time to process your request. When you opt-out from the sale of your Personal Information, we will honor your request as soon as feasibly possible, but no later than 30 days from the date we receive your request.

    RIGHT TO OPT-OUT OF THE SALE OF PERSONAL INFORMATION


    The CCPA requires businesses to disclose whether they sell Personal Information. As a business covered by the CCPA, we do not sell Personal Information. Instead, we may share Personal Information with third parties or allow them to collect Personal Information from our Sites if those third parties are authorized Service Providers or business partners who have agreed to our contractual limitations as to their retention, use, and disclosure of such Personal Information, or if you interact with these third-parties through the Sites or direct us to disclose your Personal Information to third parties.

    RIGHT TO NON-DISCRIMINATION FOR THE EXERCISE OF A CONSUMER’S PRIVACY RIGHTS


    California consumers have the right to not receive discriminatory treatment for exercising CCPA rights. We will not discriminate against you for exercising your CCPA rights.

    CALIFORNIA SHINE THE LIGHT LAW


    If you are a California resident, in addition to the rights set forth above, you have the right to request information from us regarding the manner in which we share certain categories of your personal information with third parties for the third parties' direct marketing purposes. California law provides that you have the right to submit a request to us at the designated address and receive the following information:
    • The categories of information we disclosed to third parties for the third parties' direct marketing purposes during the preceding calendar year;
    • The names and addresses of third parties that received such information, and
    • If the nature of a third party's business cannot be reasonably determined from the third party's name, examples of the products or services marketed.

    NOTICE TO NEVADA RESIDENTS


    If you are a Nevada resident, in addition to the rights set forth above, you have the right to request that we do not make any sale (as such term is defined in N.R.S. 603A) of your covered information (as such term is defined in N.R.S. 603A.320) that we may have collected from you (or may collect from you in the future). We currently do not sell covered information, as “sale” is defined by such law, and we don’t have plans to sell this information.
